Goal

General principles
Article 5 - General principles for the control of environmental noise are as follows:
a) No one may operate or cause a motor vehicle to operate without a muffler or other sound absorber, and the muffler or sound absorber on a motor vehicle or motorcycle shall not be removed or rendered inoperable except for the purpose of maintenance or other replacement.
b) On or in a motor vehicle; it is prohibited to steal the horn or any other sound generating device, which may cause noise disturbance, except when required.

d) In areas where there are noise sensitive structures listed in Table-12 attached to Article 31 of this Regulation ; speak loud , b It is forbidden to make propaganda, advertisement, announcement, promotion and sale by using vehicles such as entertainment, sound amplifier (announcement systems) and making pulsed regular or irregular sounds.
e) It is forbidden to carry out trial works on marine engines, motorcycles or any motor vehicles in the seating areas and in the immediate surroundings and in noise sensitive areas. .
f) Model vehicles such as model marine engines and model airplanes; It is forbidden to operate and allow to be operated between 20.00-06.00 in noise sensitive and public areas with seating areas and close surroundings.
g) Mechanical or motorized sewing in residential areas and other noise sensitive areas including indoor and outdoor machine , drill, saw, grinder, lawn mower machine , treadmills or similar vehicles between the hours of 19.00-07.00 to be allowed to start or run.
h) It is forbidden to carry out similar activities such as using explosives, sparklers and similar things in public areas, roads and sitting areas.
(i) Any fire alarm, robbery alarm or civil defense alarm, siren, whistle or similar emergency signaling devices shall not be allowed to be deliberately operated or permitted except in cases of emergency such as fire, air strike, robbery and forced trials. Duties, powers and responsibilities of the Ministry
Article 6 - The Ministry;
a) To determine the programs and policies to reduce environmental noise , to ensure cooperation and coordination in the implementation of this Regulation and to take administrative measures in order to develop an environment that will not disturb the physical and mental health, peace and tranquility of individuals with noise ,
b) To determine the authorization principles of the institutions and organizations that will carry out the measurements specified in this Regulation, to prepare reports, maps and action plans, to evaluate the applications to be made for this purpose and to give a Certificate of Proficiency in case it is found suitable, to audit the institutions and organizations that have been given the Certificate of Qualification, in case of violation of this Regulation and the principles of authorization to ensure the enforcement of the necessary sanctions and, if necessary, to cancel the authorization,
c) To issue the Noise Control Permit Certificate to the enterprises listed in Annex-VII list A of this Regulation, to renew the Noise Control Permit Certificate, to audit the enterprises within this framework, to ensure that the necessary sanctions are applied in case of violation of the principles specified in this Regulation and to cancel the Noise Control Permit Certificate,
d) Strategic Noise Maps and Action Plans; Ministry, Ministry of Public Works and Settlement, Ministry of Transport, Ministry of Health, Ministry of Industry and Trade, State Planning Organization, Undersecretariat of Treasury, governorship, metropolitan municipality and / or Providing approval and approval by the committee consisting of representatives of provincial / district / first degree municipality, special provincial administration, research institutions, public institutions and professional organizations and non-governmental organizations,

j) To prepare or have explanatory user manuals, manuals and similar documents required by this Regulation,
k) Ensuring that the information, documents and documents essential to the Acoustic Report are determined and published,
l) To prepare or have awareness programs prepared to prevent and reduce environmental noise,
authorized and responsible.
Measures to be taken by the local authorities
Article 7 - The highest civil authority of the locality;
a) Identifying the enterprises operating within the provincial boundaries and listed in Annex A-VII of this Regulation, and notifying the Ministry,
b) Outside the boundaries of the municipality and adjacent areas; To issue the Noise Control Permit Certificate for the enterprises listed in Annex-VII List B of this Regulation, to renew the Noise Control Permit Certificate, to audit the enterprises within this framework, to ensure that the necessary sanctions are applied in case of contradiction to the principles specified in this Regulation and to cancel the Noise Control Permit Certificate,

3) Determining the appropriate areas and periods to control the noise level spreading to the environment from concerts, shows, rallies, ceremonies, festivals, weddings and similar outdoor activities ,

Measures to be taken by local administrations
Article 8 - The measures to be taken by the local administrations are given below.
a) Special provincial administrations; It looks for the Noise Control Permit Certificate in the opening and working licenses to be issued within the scope of the Regulation on Non-Sanitary Enterprises or other legislation outside the boundaries of the municipality and adjacent areas .
b) Municipalities;
1) Preparing strategic noise maps and related action plans,
2) By submitting to the Ministry the list of road, rail, air-space and residential areas that are required to prepare a strategic noise map,
3) With the opening of strategic noise maps and related action plans to public opinion,
4) Preparing performance reports and presenting them to the Ministry for noise sources that are not obligatory to prepare strategic noise maps,
5) To submit the Noise Control Permit Certificate for the enterprises listed in Annex-VII List B of this Regulation, to renew the Noise Control Permit Certificate, to audit the enterprises within this framework and to ensure that the necessary sanctions are applied in case of contradiction to the principles specified in this Regulation and, if necessary, to cancel the Noise Control Permit Certificate. ,
6) In areas other than those listed in paragraphs (d), (h) and (j) of this Regulation; making propaganda, advertising, announcement, promotion and sales by using tools such as sound amplifiers (announcing systems) and making pulsed regular or irregular sounds, using sparklers and similar things, firing and similar activities, and concerts, shows, rallies, ceremonies, festivals, identifying appropriate areas and durations to control the level of noise emitted by the environment from similar outdoor activities,
7) In the architectural projects, installation projects and building licenses of the buildings, by making the appropriate arrangements regarding the clauses (c), (d) and (e) of Article 28 and Article 31 of this Regulation and searching for the conditions mentioned in the project control,

Obligations of relevant public institutions or organizations
Article 9 - Obligations of the relevant public institutions or organizations;
a) Principles and procedures for determination and monitoring of noise exposure levels taking into account hearing health and critical health effects by the Ministry of Health pursuant to the Decree Law No. 181 dated 13/12/1983 on the Organization and Duties of the Ministry,

Obligations of the operating owners
Article 10 - During the planning and operation of the noise sources in this Regulation, operators shall:
a) Preparation of strategic noise maps and the preparation and implementation of action plans for the prevention and reduction of noise where environmental noise exposure around the noise source is likely to have detrimental effects on human health and where environmental noise quality is required ,
b) To open strategic noise maps and related action plans to the public opinion,
c) To submit to the Ministry the list of road, rail, airport and residential areas that are required to prepare a strategic noise map,
d) Preparing and presenting to the Ministry the performance report regarding the control measure to be taken if it is determined whether or not the limit value given in this Regulation is provided for the noise sources that are not obliged to prepare a strategic noise map,
e) Ensuring that the noise related part of the Environmental Impact Assessment Report to be prepared for the activities subject to the Environmental Impact Assessment Regulation shall be prepared in accordance with the principles contained in this Regulation,
f) To meet the environmental noise criteria for the enterprises listed in Annex A-VII List A and B of this Regulation,
g) To evaluate and report the environmental noise through measurement and / or calculation in accordance with the principles and procedures specified in this Regulation by the operator of the facility,
h) To carry out environmental noise measurements jointly by the enterprises carrying out the same activities in the regions established by the decision of the Council of Ministers,
ı) Receiving the Noise Control Permit Certificate by presenting the Acoustic Report prepared by the institutions or organizations that have been granted Competency Certificate by the Ministry
j) For other noise sources not subject to the permission imposed under this Regulation ; to take necessary measures to ensure limit values and to ensure their control,
